General Terms and Conditions (SaaS / Software / Plugins)

1. Scope of Application

These General Terms and Conditions (GTC) apply to the use of software products, plugins, and digital services (hereinafter „Software“) offered on software.vastcob.com.

Sales, payment processing, invoicing, and tax remittance are handled by an external payment provider (Merchant of Record), specifically Paddle.com or LemonSqueezy.

2. Contractual Relationship

The purchase contract for the Software is concluded exclusively between the customer and the respective payment provider (Paddle or LemonSqueezy).

The provider of software.vastcob.com acts as the licensor and technical service provider, not as the seller.

3. Service Description

The offered Software includes digital WordPress and WooCommerce plugins, as well as associated updates, documentation, and optional support services.

The scope of functions is determined by the respective product description at the time of purchase.

4. Rights of Use (License)

The customer receives a simple, non-transferable, time-limited right of use to use the Software in accordance with the product description.

Transfer, reproduction, rental, sublicensing, or use on unauthorized domains is prohibited unless expressly permitted.

5. Updates & Further Development

The provider is entitled to further develop, modify, or adapt the functions of the Software, provided that no essential core function is removed.

There is no entitlement to specific future functions.

6. Availability

The Software is provided „as is„.
There is no claim to permanent availability, especially not during maintenance work, updates, or force majeure.

7. Liability

The provider is liable only for intent and gross negligence.
In cases of simple negligence, the provider is liable only for the breach of essential contractual obligations (cardinal obligations) and limited to the typically foreseeable damage.

Liability for lost profits, data loss, or consequential damages is excluded.

8. Warranty

Statutory warranty rights apply, where applicable.
For digital products, the provider may first remedy defects (bug fix, update) before further claims arise.

9. Termination & Cancellation

In case of a breach of these GTC, the provider is entitled to block or terminate access to the Software.

License fees already paid will not be refunded in this case.

10. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations of the country of residence remain unaffected.
