The cookie notice obligation has been around for a long time, but the unclarity still persists. A website without any cookies can only function very rudimentarily. An online shop without cookies is not possible at all without annoying customers, and as soon as useful functions are added, it becomes even more difficult. Visitor tracking, i.e., reach measurement, as well as certain marketing cookies, can now only be activated with consent and should be available to the visitor for selection or deselection BEFORE entering the page. The Cookie Banner Text is therefore essential and extremely important, as it provides the visitor with the first visible information within the framework of the GDPR and TTDSG.
The „correct“ cookie notice text according to ECJ, GDPR and BGH ruling
A cookie notice with text defining the specific cookie situation for each website or online shop is mandatory. In principle, the following always applies in the context of data protection:
- Principle of data minimization
- Is there a legitimate interest?
- Does the user have the option to use the site without statistics & marketing cookies?
Cookies for cross-device user profiles are primarily:
- Preference cookies
- Statistics cookies
- Marketing cookies
As soon as a user is identified and traceable, active consent in the cookie banner/notice should be required.

- Necessary / Essential
Necessary cookies help make a website usable by enabling basic functions like page navigation and access to secure areas of the website. The website cannot function properly without these cookies. - Preferences / Functional
Preference cookies enable a website to remember information that influences the way a website behaves or looks, such as your preferred language or the region you are in. - Statistics
Statistic cookies help website owners understand how visitors interact with websites by collecting and reporting information anonymously. - Marketing
Marketing cookies are used to track visitors across websites. The intention is to display ads that are relevant and engaging for the individual user and therefore more valuable for publishers and third-party advertisers. - Unclassified
Unclassified cookies are cookies that we are in the process of classifying, together with the providers of individual cookies.

A legend with superscript numbers for clear identification of which cookies belong to which of the above-mentioned categories. Example cookie banner text: If you accept all services, you allow Emojis1, Google Maps1, Google Fonts1, Matomo2, and Facebook Pixel3 to be loaded. These are divided by their purpose into groups Functional1, Statistics2, and Marketing3 (affiliation indicated by superscript numbers).
